Medical Malpractice

In a general sense, North Carolina law states:
The patient or the patient’s representative has the burden of proof to prove by the greater weight of the evidence, to a reasonable degree of medical certainty, and through the testimony of legitimate and credible physicians and/or other medical experts the following elements:
First, it must be shown that there has been some aspect of “medical carelessness” in some facet of the medical care;
Second: it must be shown that there is “causation”;
Third: it must be shown that there is an injury or death.
In other words, the patient and/or the patient’s representative must prove through the testimony of physicians and/or other medical experts that there has been medical carelessness which caused the patient’s injury or death.
